NON-COMPETITION AGREEMENTS
The "world wide web" has revolutionized the global job market. Today's employees have unlimited employment-search resources at the touch of their fingers. Sometimes finding a new job can be as easy as punching a button. As a result, employers find themselves battling costly turnover. Many employers try to restrain employees from competing in the same market after separation through the use of non-competition agreements. However, progressive employers understand that providing job satisfaction is an ever-important ingredient for business success. With retained counsel, an employee can often negotiate a favorable employment agreement that helps provide job satisfaction, security and freedom from restraint.
SEVERANCE AGREEMENT
Many of today's employers understand the value in agreed separation. Both the employee and the employer can benefit by reaching a severance agreement. Most severance agreements provide the employee with extended wages and/or benefits beyond the employee's separation. In exchange, most employers will require the employee to sign a release of legal claims the employee may have against the employer. Often, retention of an attorney can help the employee maximize the benefit an employer is willing to offer.
WAGE AND HOUR ISSUES
Sometimes employers try to save money by not paying their employees the full wages they are due. The Fair Labor Standards Act of 1938, as amended, (FLSA) is a federal law that sets forth minimum wage standards (currently $5.15) and requires non-exempt employees to be paid overtime at one and one-half times their regular rate for all hours worked over forty per workweek. The employer must have at least two employees for the act to cover an employee.
Additionally, the Equal Pay Act of 1963 is a federal law that prohibits gender discrimination in an employee's wages. The employer must have at least one employee for the Act to apply.
